These Terms of Use ("Terms") govern access to gracefuldrflex.world and the purchase and use of online programs for office workers offered by Gracefuldrflex. By using the website or enrolling in a program, you agree to these Terms.
Eligibility
You must be at least 18 years old and able to form a binding contract. If you enroll on behalf of an organization, you represent that you have authority to bind that entity.
Services Description
Gracefuldrflex provides educational online content focused on desk mobility, posture awareness, focus routines, and related workplace movement practices. Programs include on-demand video, downloadable materials, and optional coach correspondence. We do not provide medical services, clinical diagnoses, or emergency support.
Account and Access
Upon purchase, you receive access credentials or secure links valid for the period stated at checkout, typically twelve months unless otherwise noted. You are responsible for safeguarding login details and notifying us of unauthorized use. Sharing accounts outside licensed seat counts is prohibited.
Pricing and Payment
Prices are displayed in US dollars on the program catalog. Taxes may apply based on billing location. Payment is due at checkout unless a written enterprise agreement specifies net terms. Failed payments may suspend access until resolved.
Intellectual Property
All website content, videos, audio, graphics, trademarks, and curricula are owned by Gracefuldrflex or licensors. You receive a limited, non-exclusive, non-transferable license for personal or internal business learning during your access period. You may not copy, redistribute, publicly perform, reverse engineer, or create derivative works for commercial resale.
Acceptable Use
You agree not to misuse the platform, including attempts to breach security, scrape content at scale, harass staff, upload malware, or use programs in ways that violate law or third-party rights.
Health and Safety Disclaimer
All programs are for general education about workplace movement and focus habits only. They are not medical advice, diagnosis, treatment, or a substitute for care from a licensed clinician. Consult a qualified professional before starting new movement routines if you have injuries, pain, or conditions that require personalized guidance. Stop any exercise that causes sharp pain, dizziness, or shortness of breath and seek appropriate care. We do not claim that participation will prevent, treat, or cure any health condition.
Team and Employer Licenses
Enterprise packages may include aggregate reporting without individual health details. Employers must inform participants that enrollment is voluntary unless otherwise required by separate written policy compliant with applicable labor laws.
Disclaimer of Warranties
Services are provided "as is" and "as available" to the fullest extent permitted by law. We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee specific productivity or comfort outcomes.
Limitation of Liability
To the maximum extent permitted by law, Gracefuldrflex and its officers, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for claims arising from a program purchase shall not exceed the amount you paid for that program in the twelve months preceding the claim.
Indemnification
You agree to indemnify and hold harmless Gracefuldrflex from claims arising from your misuse of the services, violation of these Terms, or infringement of third-party rights.
Termination
We may suspend or terminate access for material breach, fraud, or abuse. You may stop using services at any time. Sections that by nature should survive termination will remain in effect.
Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law rules. Disputes shall be brought in courts located in Harris County, Texas, unless applicable law requires otherwise.
Changes
We may modify these Terms. Continued use after posting constitutes acceptance of revised Terms for new activity. Material changes to paid services will be communicated when practicable.
